Seller's trade registry number: 343185-5. Tax office (vergi dairesi): Beylikdüzü Vergi Dairesi. In this contract the seller acts in its own name under the brand Yiğit Alüminyum Profil.
The buyer is the person who places an order by accepting this contract and whose full name and contact details appear in the order summary. The invoice details, the person who will take delivery and the delivery address are provided by the buyer when the order is created and are checked before payment. The order summary forms an integral part of this contract.
Subject matter, scope and formation
This contract governs the sale and delivery of the standard aluminium profiles listed in the order summary of an order placed via www.yigitaluminyumprofil.com or the WhatsApp line 0532 642 72 80. The order number, the transaction date and the records relating to the formation of the contract are kept together with the relevant order.
This text has been prepared for consumer transactions. Where the purchase is made for commercial or professional purposes, the provisions specific to consumers apply only to the extent that they are legally applicable; the general and relevant commercial provisions are reserved. The scope of the rights granted to the consumer may not be narrowed on the basis of a choice made on the invoice.
The Preliminary Information Form and the order summary containing the buyer, product, price, payment and delivery details form an integral part of the contract and are presented to the buyer together before payment. The order becomes final when the buyer confirms the details, accepts this contract and the PayTR payment is completed successfully. There is no approval stage that gives the seller a separate, arbitrary power to accept or reject. The contract, the preliminary information and the order summary are sent to the buyer's email address in a form that can be stored.
Products, price and payment plan
The name, code, basic dimensions, model or variant, unit of sale, quantity, parts included in the package, unit prices including taxes and subtotals of the products sold are stated in the order summary. The LED profile cover stated in the product description is included in the package. Other parts are deemed included only if they are expressly shown in the order. Custom cutting, painting, tooling or bespoke manufacture is not the subject of this sale.
The product total including taxes, any discount and its conditions, the VAT details, the delivery charge, any other legally valid charges and the grand total payable are shown in the order summary. Prices are in Turkish lira. The single payment or instalment plan selected on the payment screen is included in the order summary together with the number of instalments, their amounts and the total price. These amounts, accepted by the buyer before payment, constitute the price of the contract.
Payment is made by credit card via PayTR. The seller does not charge a separate commission merely because payment is made by card. Where a legally valid instalment or financing difference exists, its nature and total cost are included in the amounts shown before payment. No undisclosed additional service, insurance, packaging or other charge arises automatically. A service added to the order at a later stage is provided only under a separate and express agreement.
The seller's delivery obligation
Standard shipments are made with Aras Kargo. The delivery method, carrier, delivery address, dispatch period, the committed delivery period or date and any special conditions for the order are shown in the order summary before payment. The seller carries out delivery in accordance with these conditions as accepted by the buyer.
Products in stock are prepared for dispatch and handed over to the carrier within 1–3 working days; standard products that are not in stock but are available to order within 3–7 working days. Dispatch takes place Monday–Saturday; Saturday is included in the calculation of the period, and no dispatch takes place on Sunday. Delivery is completed within the period committed to in the order and, in any event, no later than 30 days from the date on which the order reaches the seller. Handing the goods over to the carrier does not constitute delivery to the consumer.
The seller is obliged to deliver the products with the characteristics, in the quantity and with the included parts stated in the order, and in a manner suitable for transport. The risk of loss and damage rests with the seller until the consumer, or a third party designated by the consumer other than the carrier, actually takes delivery of the product. Where the consumer requests delivery to a carrier that the consumer has personally chosen, other than those offered by the seller, the statutory passing of risk applies; the seller's liability arising from its own fault is preserved.
For collection from the shop or delivery through the customer's own carrier, the place, time and person taking delivery are agreed at the time of the order. The address is Beylikdüzü OSB Mah. Birlik Sanayi Sitesi Açelya Cad. No: 1/1 İç Kapı No: 17 Beylikdüzü / İstanbul. For large orders, delivery within Istanbul by dedicated vehicle applies only if the charge and scope have been agreed in advance. Installation service is not included in the contract.
The buyer's obligations and correction of information
The buyer provides the necessary address and contact details correctly, uses a means of payment that the buyer is authorised to use and checks for errors in the summary before placing the order. The product, quantity and address details may be corrected until the payment is confirmed. For a change required afterwards, the seller may be contacted; a written agreement is reached depending on the state of performance. The buyer's obligation to provide information does not remove the seller's legal responsibilities.
It is recommended that the product and package be checked on delivery and that, in the event of an evident problem, a carrier's report or photographs be obtained. Failure to do so does not automatically result in the loss of statutory rights of recourse. No short, strict notification requirement that shifts the seller's defective delivery onto the buyer is applied.
Delay and impossibility of performance
If the seller fails to comply with the committed delivery period, the consumer may terminate the contract. Within 14 days from the date on which the notice of termination reaches the seller, the payments collected, including delivery costs, are refunded together with statutory interest in accordance with the legislation. Other statutory claims and rights to compensation are reserved.
If performance genuinely becomes impossible, the seller notifies the buyer in writing or by means of a durable medium within three days from the date on which it becomes aware of the situation. All payments collected, including delivery costs, are refunded no later than 14 days from the notification. The fact that a product is out of stock does not in itself constitute impossibility. No other product or goods with different characteristics may be sent without the buyer's express approval. A general force majeure clause may not be used to set aside the consumer's mandatory rights.
Exercise of the right of withdrawal
The consumer may withdraw from the contract within 14 days from the date on which the consumer, or a third party designated by the consumer other than the carrier, takes delivery of the product, without having to give any reason or pay any penalty. The right of withdrawal may also be exercised before delivery. If the products of the same order are delivered on different dates, the delivery date of the last product is taken as the basis; if the product consists of more than one part, that of the last part. Handing the product over to the carrier does not start this period.
The withdrawal statement may be addressed, before the period expires, by email to info@yigitaluminyumprofil.com, by written message to the WhatsApp line 0532 642 72 80 or by written notice to the seller's address at Beylikdüzü OSB Mah. Birlik Sanayi Sitesi Açelya Cad. No: 1/1 İç Kapı No: 17 Beylikdüzü / İstanbul. It is sufficient for the statement to identify the order and clearly state the decision to withdraw. The use of a specific form, the giving of reasons, the seller's approval or obtaining a return code in advance is not a condition of the right of withdrawal. It is recommended that records showing that the notification was made be kept.
If proper information on the right of withdrawal has not been provided, the consumer is not bound by the ordinary 14-day period; the right expires one year after the end of the normal withdrawal period. If proper information is provided during this one-year period, the 14-day period begins on the date on which the information is provided.
This order does not involve bespoke manufacture or cutting; the right of withdrawal exists for standard products. The fact that the product is a long profile or was purchased with a quantity discount does not remove this right. The seller may not make the exercise of withdrawal conditional on approval of eligibility, inspection photographs or obtaining a return code in advance.
Return and refund after withdrawal
Unless the seller offers to collect the product itself, the consumer must send the product back to the seller or to a person authorised by the seller within 14 days from the date on which the consumer addressed the notice of withdrawal. Returns address: Beylikdüzü OSB Mah. Birlik Sanayi Sitesi Açelya Cad. No: 1/1 İç Kapı No: 17 Beylikdüzü / İstanbul. Carrier designated for returns: Aras Kargo. The shipment details required for handing the product over to the carrier are shared through the contact channels; this step is not turned into an approval stage that would delay the notice of withdrawal.
Where the return carrier stated in the preliminary information is used, no return shipping charge is collected from the consumer. If no return carrier is stated in the preliminary information, no return cost may be requested from the consumer. If the stated carrier has no branch where the consumer is located, the seller arranges for the product to be collected from the consumer without any additional charge. Where the consumer wishes to use a different carrier of the consumer's own choosing, the position on costs is explained before dispatch; costs that the seller is obliged by law to bear are not passed on to the consumer.
Within 14 days from the date on which the product subject to withdrawal is handed over to the return carrier stated in the preliminary information, the price collected for the relevant product and the delivery costs that must be refunded under the legislation are repaid. If another carrier is used, this period begins on the date on which the product reaches the seller. In the case of withdrawal before delivery, the period is 14 days from the date on which the notice of withdrawal reaches the seller. Where the whole order is withdrawn from, the delivery charge collected is also refunded.
The refund is made in a single payment, in a manner appropriate to the means of payment used for the purchase and without imposing any cost or additional obligation on the consumer. For credit card payments the refund is processed via the card; even if the payment was made in instalments, the seller does not split the refund amount into instalments. The bank's process for posting the refund to its account and limit records does not remove the seller's obligation to refund in due time. A shopping voucher, points or a requirement to make a new purchase may not be imposed in place of a refund.
The consumer sends the product together with the parts received and in a manner that protects it during return transport. The consumer is not held liable for changes and deterioration arising during the withdrawal period from use in accordance with the product's functioning, technical specifications and instructions for use. Opening the original packaging is not in itself a ground for refusal. Actual losses alleged to have arisen from unlawful interference for which the consumer is responsible are assessed separately within the framework of proof and statutory limits; no unilateral, arbitrary penalty or deduction is applied.
Defective goods and after-sales rights
The seller may be contacted regarding products that are incorrect, incomplete, damaged or lacking the characteristics stated in the contract. Within the framework of the statutory conditions, the consumer may exercise one of the following rights: rescission of the contract with a refund of the price, a price reduction in proportion to the defect, free repair where this does not entail excessive cost, or replacement with a defect-free product where possible. The statutory proportionality provisions applicable to the choice of remedy are reserved; the necessary costs are not passed on to the consumer.
Where a refund of the price or a price reduction is chosen, the repayment is made immediately. Requests for repair or replacement are fulfilled no later than 30 working days from the date on which the request is made, unless a shorter specific period is prescribed for the relevant product. Unless a longer period is provided for in other laws or in the contract, liability for defective goods is subject to a limitation period of two years from delivery. This limitation does not apply where the defect has been concealed through gross fault or fraud.
Photographs, video, packaging or a carrier's report may facilitate the examination; their absence is not in itself a ground for refusing statutory rights. The fact that no additional commercial guarantee or installation service is offered does not remove the seller's statutory liability arising from defective goods.
The statutory presumption that a defect appearing within the first six months after delivery existed on the delivery date applies, except in cases incompatible with the nature of the goods or of the defect. The consumer's right to claim compensation under the Turkish Code of Obligations (Türk Borçlar Kanunu) and the other avenues of recourse provided by the legislation are reserved.
Records, personal data and notifications
The contract is sent by email; transaction records are retained for the statutory periods. The consumer may request a copy of the records after transaction and identity verification. The seller's records are not deemed the sole and conclusive evidence; the statutory rules of evidence apply.
Personal data are processed for the purposes and on the legal grounds explained in the KVKK Privacy Notice (Personal Data Protection Law No. 6698). Acceptance of the contract does not constitute blanket explicit consent to unnecessary data processing, advertising messages or transfers abroad. For withdrawal and complaints, info@yigitaluminyumprofil.com, 0532 642 72 80 and the seller's postal address may be used. Specific notification methods made mandatory by law are reserved.
Disputes and governing law
Turkish law applies. A term contrary to mandatory consumer provisions is not applied to the detriment of the consumer; the remaining provisions stay in force to the extent legally possible. There is no condition that makes the seller's place of residence, on its own, the place of exclusive jurisdiction.
Depending on the monetary limits in force on the date of application, the consumer may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) at the consumer's place of residence or at the place where the transaction was carried out; and, in cases where it has jurisdiction, to the Consumer Court (Tüketici Mahkemesi). Before an action is brought before the Consumer Court, mediation as a precondition for bringing an action applies, subject to the statutory exceptions. Statutory rights of application and action are reserved.
Electronic acceptance and copy of the contract
The buyer may review and save the contract before payment. Acceptance text: “I have read and accept the Distance Sales Contract relating to my order.” The payment button is presented with the wording “Complete order with obligation to pay” or a clear expression having the same meaning. No declaration waiving statutory rights is obtained.
The time of acceptance of the contract and the version of the relevant text are stored together with the order record. The Preliminary Information Form for the order, the order summary containing the product and price details and the information on exercising the right of withdrawal are sent by email together with the contract.
